NOTICE OF FORECLOSURE SALE

STATE OF TENNESSEE, WAYNE COUNTY

   WHEREAS, Dena M. Nutt executed a Deed of Trust to United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture, Lender and Mary Ruth Tackett, Trustee(s), which was dated March 1, 2006, and recorded on March 1, 2006 in Book 79, Page 648, Instrument Number 39999 in Wayne County, Tennessee Register of Deeds.

   WHEREAS, default having been made in the payment of the debt(s) and obligation(s) thereby secured by the said Deed of Trust and the current holder of said Deed of Trust, Rural Housing Service, U.S. Department of Agriculture, (the “Holder”), appointed the undersigned, Brock & Scott, PLLC, as Substitute Trustee, with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; and

   NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and that as agent for the undersigned, Brock & Scott, PLLC, Substitute Trustee, by virtue of the power and authority vested in it, will on March 18, 2020, at 12:00PM at the usual and customary location at the Wayne County Courthouse, Waynesboro, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described property situated in Wayne County, Tennessee, to wit:

   Two (2) certain lots or parcels of land lying and being situated in the 1st Civil District of Wayne County, Tennessee, and being more particularly bounded and described as follows:

   BEING Lots Nos. 6 and 7 in Block “D” in Waynedale Subdivision plan of which is recorded in the Register’s Office of said County of Wayne, in Deed Book No. 30, page 331, to which plan reference is here made, and by such reference said plan is made a part hereof as fully as if copied herein.

   This being the real property conveyed to Dena M. Nutt, by deed of Connie Anderson Overbey Johnson and husband, William D. Johnson, dated March 1, 2006, and recorded in Record Book No. 79, page 644, Register’s Office of Wayne County, Tennessee.

   The lots above described are conveyed subject to the following restrictive covenants and conditions:
1. The said lots or building hereafter erected thereon shall not be used for the purpose of manufacturing, storing, or selling thereon or therein of any intoxicating liquor, including wine, ale or beer.

2. No building of any character or any part thereof shall be erected on said lot at a distance nearer than thirty (30) feet from the line of the street upon which such lot fronts.

3. The walls of no residence building upon said lot shall have upon the outside thereof any composition “brick siding” or any composition rock siding but this does not include “asbestos” shingles, or siding of standard manufacture.

   All of the foregoing conditions shall be construed as restrictive covenants. The lots conveyed hereby are a part of the subdivision above referred to and such restrictions are reciprocal as between all purchasers of lots in said subdivision having similar restrictions in their several deeds and may be enforced or the breach thereof may be prevented by any one or more of the purchasers of such other lot or lots having the same restrictions or conditions as to the use thereof in such subdivision.

   The sale of the property described above shall be subject to all matters shown on any recorded plat; any and all liens against said property for unpaid property taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; a deed of trust; and any matter than an accurate survey of the premises might disclose; and

   All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.

   This office is attempting to collect a debt. Any information obtained will be used for that purpose.
