OnTuesday, October 15th, 2019, Judge J. Russell Parkes of the Criminal/Circuit Court of Wayne County filed the following judgments:
Melinda Andrews pled and was found guilty of introduction of contraband into a penal facility, a class C felony. She was sentenced to three years in TDOC, which was reduced to three years supervised probation. She also received a partial revocation of probation on previous charges of sale of schedule III and two counts of sale of schedule II. Her probation will be reinstated after serving 150 days in county jail. Andrews will receive credit for time served from 09/05/19 to 10/15/19.
Daniel Alexander Bannon pled and was found guilty on one count of unlawful removal of a registration plate and two counts of simple possession of methamphetamine, all class A misdemeanors; violation of the financial responsibility law, a class C misdemeanor; theft of $2,500 or more but less than $10,000, a class D felony; and convicted felon in possession of a weapon, a class E felony. He was sentenced to a total of 352 days on the misdemeanor charges, with those sentences reduced to supervised probation. He was sentenced to a total of four years in TDOC on the felony charges. He was also ordered to pay $1,510 in fines, and ordered to forfeit his firearm to the Clifton Police Department. Bannon received a full revocation of probation on previous charges of aggravated burglary and theft over $1,000, and was ordered to serve the remainder of his three-year sentence on those charges. He will receive credit for time served from 05/02/18 to 11/07/18, from 02/15/19 to 02/15/19, and from 03/08/19 to 10/15/19.
Walter Boyd Flores pled and was found guilty of simple possession, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail, with the sentence reduced to supervised probation. Flores was ordered to pay $250 in fines.
Ernest TJ Lynn pled and was found guilty of possession of meth in an amount of .5 grams or more, a class B felony; three counts of sale of meth in an amount under .5 grams, a class C felony; and possession of a firearm during commission of a dangerous felony, a class E felony. He was sentenced to eight years in TDOC on the class B felony charge, three years in TDOC on each of the class C felonies, and two years in TDOC on the class E felony, with all sentences to run concurrently. Lynn was also ordered to pay $8,000 in fines. He will receive credit for time served from 12/14/2018 to 10/15/2019.
Nathan D. McGee pled and was found guilty of possession of meth for resale in an amount less than .5 grams, a class C felony; and possession of drug paraphernalia, a class A misdemeanor. He was sentenced to four years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with both sentences reduced to supervised probation after serving six months. He was ordered to pay $2,000 in fines. McGee will receive credit for time served from 04/04/2019 to 10/15/2019.
Casey McMahan pled and was found guilty of theft over $1,000 but less than $2,500, a class E felony, and simple possession of methamphetamine, a class A misdemeanor. He was sentenced to two years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with both sentences reduced to supervised probation after serving 30 days in county jail. He was ordered to pay $750 in fines, and was ordered to have no contact with Kurt Holt or his property on Wright Ridge Road in Cypress Inn. McMahan will receive credit for time served from 08/11/2019 to 10/15/2019.
Jeremy Kirk Stults pled and was found guilty of sale of meth in an amount of .5 grams or more, and two counts of possession of meth for resale in an amount of .5 grams or more, all class B felonies; and possession of stolen property over $1,000 but less than $2,500, a class E felony. He was sentenced to a total of 32 years in TDOC, with all sentences to run concurrently and reduced to supervised probation. Stults was also ordered to pay $6,000 in fines. He will receive credit for time served from 06/12/2018 to 06/19/2018, from 06/25/2018 to 06/26/2018, and from 07/30/2018 to 05/23/2019.
Darbie Rhea Lynch originally pled and was found guilty on two counts of official misconduct, a class E felony. She applied for and was granted an order of judicial diversion, and was placed on supervised probation for a period of two years.
Misty Streetman originally pled and was found guilty of sexual contact with an inmate, a class E felony. She applied for and was granted an order of judicial diversion, and was placed on supervised probation for a period of one year.
OnWednesday, October 16th, 2019, Judge J. Russell Parkes of the Criminal/Circuit Court of Wayne County filed the following judgments:
William Joseph Mitchell pled and was found guilty on seven counts of burglary other than a habitation, a class D felony, and two counts of theft of $1,000 or less, a class A misdemeanor. He was sentenced to two years in TDOC on each charge, with the sentences to run concurrently. Mitchell was ordered to pay restitution to Susan Linville in the amount of $15, to Ryan Holt in the amount of $610, and to Brandon Brown in the amount of $2,810.
Dustin Seth Tatum pled and was found guilty on two counts of aggravated sexual exploitation of a minor, a class C felony. He was sentenced to five years in TDOC on each of the charges, with the sentences to run concurrently.
OnThursday, October 17th, 2019, Judge J. Russell Parkes of the Criminal/Circuit Court of Wayne County filed the following judgments:
Justin Atkins pled and was found guilty of possession of drug paraphernalia, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail, with the sentence reduced to supervised probation. He was ordered to pay $150 in fines.
Michael Edward Aylesworth pled and was found guilty of assault, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail, with the sentence reduced to supervised probation.
Holly Danielle Moser pled and was found guilty of sale of schedule I heroin, a class B felony; possession of heroin for resale, possession of meth for resale in an amount less than .5 grams, and sale of meth in an amount less than .5 grams, all class C felonies; worthless checks up to $1,000 and failure to appear, both class A misdemeanors. On the felony charges, Moser was sentenced to a total of 14 years in TDOC, and was ordered to pay $6,000 in fines and $100 in restitution to Piggly Wiggly in Waynesboro. She was sentenced to 11 months 29 days in county jail on each of the misdemeanor charges, with those sentences reduced to supervised probation and to run concurrently with her TDOC sentence.
Jacob Peppers pled and was found guilty on one count of burglary other than a habitation and two counts of theft of $2,500 or more but less than $10,000, both class D felonies. He was sentenced to a total of four years in TDOC, with the sentences reduced to supervised probation after serving 90 days.
James Brandon Williams pled and was found guilty of possession of meth for resale in an amount of .5 grams or more, a class B felony; and felon in possession of a firearm, a class C felony. He was sentenced to a total of 16 years in TDOC, which was reduced to 16 years supervised probation. Williams was ordered to pay $2,000 in fines, and was ordered to forfeit all weapons to the Wayne County Sheriff’s Office.
On Thursday, October 17th, 2019, Judge J. Russell Parkes of the Criminal/Circuit Court of Wayne County filed the following probation revocation order:
William Gower was originally convicted on a charge of possession of a controlled substance (marijuana) with intent to sell. He received a partial revocation of probation, with probation to be reinstated after serving 120 days in county jail. He will receive credit for time served from 10/02/2019 to 10/17/2019.
