Substitute Trustee’s Notice of Sale

   WHEREAS, by Trust Deed, dated the 17th day of August, 2018, recorded in the Register’s Office of Wayne County, Tennessee, in Record Book 206, Pages 650-658, GRACIE LEE WILSON, conveyed in Trust to William B. Bryant, Trustee, for the Bank of Waynesboro, the real property hereinafter described to secure the payment of a certain indebtedness described in said Deed of Trust; and

   WHEREAS, the said Trustee were unable to act as such Trustee, and Bank of Waynesboro as the owner and holder of the debt secured by said Deed of Trust, appointed James Y. Ross, Sr., as Substitute Trustee by document duly recorded in the Register’s Office of Wayne County, Tennessee, in Record Book 223, Page 489, as authorized by said Deed of Trust; and

   WHEREAS, default having been made in the payment of the debt, obligations, terms and conditions provided for in said Deed of Trust, and the entire indebtedness secured by the above referenced Deed of Trust has matured and is past due and unpaid; and

   WHEREAS, the owner and holder of said Note secured by said Deed of Trust has directed the undersigned Substitute Trustee to foreclose said Deed of Trust in accordance with the terms and provisions thereof;

   NOW, THEREFORE, by virtue of the authority vested in me as Substitute Trustee under said Deeds of Trust, I will, on the 22nd day of April 2020,  at 12:15 p.m., at the East door of the courthouse in Wayne, Tennessee, offer for sale and sell at public outcry to the last, highest and best bidder for cash and in bar of the equity of redemption, the statutory right of redemption, homestead, dower, curtesy, and all rights and exceptions of every kind, all of which is expressly waived in said Deeds of Trust, the following described real property:

A certain tract or parcel of land lying and being situated in the 8th Civil District of Wayne County, Tennessee, on the waters of Forty-Eight Creek , and being more particularly bounded and described as follows:.

   BEGINNING at a point in the centerline of Forty-Eight Mile Creek, the same being a point in Summer’s South boundary line, also being the Northeast corner of the original tract of which this is a part; thence up said creek as follows: South 31 degrees West 223.5 feet; South 23 degrees 14’ West 225 feet; South 01 degrees 30’ West 294 feet to the center of an electric distribution line; thence with said distribution line, North 69 degrees 45’ West 196 feet to a point in the centerline of Forty-Eight Mile Creek Road; thence with said road as follows: North 24 degrees 28’ 07.1” West 51.27 feet; North 4 degrees 41’ 10.5” East 59.96 feet; North 29 degrees 45’ East 160.9 feet; North 17 degrees 42’ 00.7” East 99.85 feet; North 26 degrees 47’ 59.9” East 169.64 feet; North 38 degrees 49’ 45.6” East 184.49 feet; thence leaving said road with Summer’s South boundary line, South 83 degrees 31’ East 110 feet to the beginning, containing 2.38 acres, more or less, subject to road easement, electric distribution line easement and any other that may exist, according to the survey of Larry G. Baker, Tennessee Licensed Surveyor, No. 198.

    This being the same real property conveyed to Gracie Lee West (now Wilson), by deed of Rebecca Cummins, dated September 28, 1994, of record in Deed Book 136, Page 562, Register’s Office of Wayne County, Tennessee.  Furthermore, this being the real property conveyed to Richard David Wilson, by deed of Gracie Lee West Wilson, dated January 22, 2007, of record in Record Book 92, Page 471, Register’s Office of Wayne County, Tennessee (said deed created a tenancy by the entirety by and between the aforesaid individuals).  The said Richard David Wilson is now deceased and Gracie Lee Wilson became the sole owner of the herein above described real property as the surviving tenant by the entirety.

   The street address of the above-described property, whether real, personal or otherwise, is believed to be: 4499 S Fortyeight Road, Waynesboro, Tennessee, 38485; but such address is not part of the legal description of the property described herein above and, in the event of any discrepancy, the legal description herein shall control.  

   Said real property will be sold subject to any and all unpaid taxes, restrictive covenants, subdivision restrictions, and building lines, easements for public utilities, and other easements, and any and all prior restrictions, encumbrances, fixture filings,  liens of any nature, including Federal Tax Liens and State Tax Liens and statutory rights of redemption of any county, municipal, state or federal governmental entity, and any matter that an accurate survey, or personal observation,  of the premises might disclose. In addition, the following parties’ may claim an interest in said property, to wit:

Lien Holders: Bank of Waynesboro

Other Interested Parties: Wayne County Trustee

   The right is reserved to adjourn the day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth herein. If the highest bidder cannot pay the bid, then the next highest bidder, at their highest bid, will be deemed the successful bidder. However, this property is being sold with the express reservation that the sale is subject to confirmation by the owner/holder or trustee/substitute trustee, and this sale may be rescinded at any time by the owner/holder or substitute/trustee.

    Title to said real property is believed to be good, but I will sell and convey he same only as Substitute Trustee, and the buyer must rely upon his or her own judgment and investigation as to the status of title.

   The purpose of this communication is to collect a debt and any information obtained will be used for the purpose of collecting said indebtedness.
