Whereas, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust dated March 7, 2006, executed by Tammy Lovone Marks, conveying certain real property therein described to James R. Frazier, as Trustee, as same appears of record in the Register’s Office of Wayne County, Tennessee, recorded March 13, 2006, in Record Book 80, page 67; and WHEREAS, the beneficial interest of said Deed of Trust was last transferred and assigned to Habitat for Humanity Williamson-Maury, who is now the owner of said debt; and WHEREAS, the undersigned Russell J. McCann, having been appointed as Substitute Trustee by instrument filed for record in Record Book 219, page 586, Register’s Office of Wayne County, Tennessee.  NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that the undersigned, Russell J. McCann, as Substitute Trustee or his duly appointed agent, by virtue of the power, duty and authority vested and imposed upon said Substitute Trustee will, on January 21st, 2020 at 10:00 AM at the Front Door of the Wayne County Courthouse, 100 Court Circle, Waynesboro, TN 38485, proceed to sell at public outcry the below described real property and improvements to the highest and best bidder for cash or certified funds; provided, however, if the high bidder executes an affidavit that he/she/they will be owner occupants then the Trustee may, in its discretion, offer the following terms of sale: ten percent (10%) non-refundable deposit at time of auction, balance due at Closing, to be held at a time and place of Trustee’s discretion, not to exceed forty (40) days from date of sale.  Property being sold: situated, lying and being in the 8th Civil District of Wayne County, adjacent to and southeast of Red Oak Road, about 0.03 miles east of the intersection with Miller Lane and more particularly described as follows: Beginning at an iron pin set in the center of Red Oak Road, about 175.00 feet easterly of the intersection with Miller Lane; thence with the center of Red Oak Road, N 23 degrees 31’ 20” E, 47.40 feet, a small post oak, a corner of Tammy Marks (RB 154 Page 416 ROWCT); thence with a new division line, S 81 degrees 15’ 02” E, 134.33 feet to an iron pin set; thence S 6 degrees 57’ 28” E, 97.38 feet, an iron pin set; thence S 69 degrees 38’ 34” W, 93.25 feet, an iron pin set; thence N 42 degrees 05’ 56” W, 138.22 feet to the point of beginning, containing 0.38 acre, more or less and being a portion of the property as described in RB 154, p. 416 ROWCT and parcel 5.03 Map 082 PAOWCT, also in this conveyance, a water rights and maintenance easement, 20.00 feet wide, to the existing well, located 40.00 feet, more or less, easterly of the NE corner of this tract.  THIS CONVEYANCE IS SUBJECT TO ANY AND ALL EXISTING EASEMENTS AND RESTICTIONS AS SHOWN OF RECORD, Parcel ID: 082-005.09, PROPERTY ADDRESS: the street address of the property is believed to be 162 Red Oak Rd., Lawrenceburg, TN  38464. In the event of any discrepancy between this street address and the legal description of the property, the legal description of the property, the legal description shall control. CURRENT OWNER(S): Tammy Lovone Marks. OTHER INTERESTED PARTIES: none known. The sale of the above-described property shall be subject to all matters stated in Deed Book 154, pages 416 said register’s office, and shown on any recorded plat; any unpaid taxes; any restrictive covenants, easement or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. This property is being sold with the express reservation that it is subject to confirmation by the lender or Substitute Trustee. This foreclosure sale may be canceled at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.
