   WHEREAS, on May 15, 201, BRANDON HOOD executed a promissory note to the order of Lawrenceburg Federal Bank payable according to its terms, which said note provided that at the option of the holder thereof, in the event said note was not paid when due, the whole of the same, the entire balance, could be declared due and payable; and

   WHEREAS, the said note is in default and the holder thereof has instructed me, William Eledge, Substitute Trustee, to foreclose same and collect said note;

   NOW, THEREFORE, by virtue of the authority vested in me as Substitute Trustee as contained in Deed of Trust from Brandon Hood and Haylie Hood which said Trust Deed is recorded in Record Book 214, page 278-285, Register’s Office of Wayne County, Tennessee, notice is hereby given that the property described below will be sold by me at the Courthouse in Wayne County, Tennessee, at public auction, to the highest and best bidder for cash, subject to all unpaid taxes, on:

WEDNESDAY, AUGUST 25, 2021 at 10:00 A.M.

PROPERTY ADDRESS: 1201 Moccasin Creek Road, Waynesboro, TN  38485

CURRENT OWNER: Brandon Hood and Haylie Hood

   The proceeds of the said sale will be applied first to the cost of the sale, including attorney’s fees and cost of publication notice; second, to pay the first mortgage to Lawrenceburg Federal Bank as set out above; third, if any remains, to the maker of the note as provided for in said note and deed of trust.

   The said property is described as follows:

A certain tract or parcel of land lying and being situated in the 1st Civil District of Wayne County, Tennessee, on the waters of Moccasin Creek, and bounded and described as follows:

Beginning at a stake in the center of so-called Moccasin Creek graded road at intersection; thence with center of said Moccasin Creek graded road as follows: North 35 degrees West 15 8/25 poles; North 28 degrees West 12 16/25 poles, North 18 degrees West 17 14/25 poles to stake in center of said Moccasin Creek graded road and hollow branch; the same being the most southern southeast corner of tract owned by Virgil Skelton; thence with south boundary line of said Virgil Skelton land passing just along the south side of said branch and along the North edge of a little roadway leading from a hog lot up a hollow as follows; South 53 degrees, West 150 feet to a stake; South 56 degrees West 206 feet to a stake; South 46 degrees West 82 feet to a small walnut tree at corner of hog lot; thence North 80 degrees West 55 feet to stake in center of branch; thence South 53 degrees West 125 feet to stake in a fence line; thence with fence South 65 degrees West 74 feet to a post oak at corner of fence; thence South 5 degrees West 205 feet to a beech at corner of fence; thence South 35 degrees West 46 feet to stake in branch and west boundary line of tract of which this is a part and east boundary line of the first tract of 172.5 acres described in deed of Joe Whitehead and wife, to Hassell and Hughes Lumber Company by deed dated April 1, 1961, and record in Deed Book No. 42, Page 463, Register’s Office of Wayne County, Tennessee with poplar, sourwood and persimmon pointers; thence South 40 degrees East passing the southeast corner of said 172.5 acre tract and a Northwest corner of said R.M. Hughes, Jr. 400.6 acre tract at 17 19/25 poles in all 100 poles to a dogwood with 2 red oak, white oak, sassafras and 2 hickory pointers the same being the Northwest corner of Parcel No. 1 described in deed of Carl Whitehead, a single person, to Jimmy Skelton and wife, by deed dated June 1, 1971, recorded in Deed Book No. 55, page 116, Register’s Office of Wayne County, Tennessee; thence South 3 degrees West 63 poles to a stake on North hillside with 2 red oak, one post oak and 2 chestnut oak pointers, the same being the southwest corner of said Parcel No. 1, also another corner of said Hughes 400.6 acre tract; thence South 87 degrees East crossing new graded road at 23 5/25 poles passing the southeast corner of said Parcel No. 1 at 30 ½ poles in all 37 poles to iron stake on east side of the old graded road near T.V.E.C power line, same being another corner of said Hughes 400.6 acre tract; thence with or near the east margin of said old graded road North 7 degrees West 33 poles to iron stake on east margin of same near said power line in the east boundary of line of said Parcel No. 1; thence North 24 poles to a stake with 2 white oak, 1 hickory, and 1 back oak pointers, the same being the Northeast corner of Parcel No. 1 and another corner of said Hughes 400.6 acre tract; thence continuing in a northwestwardly direction with the centerline of the so-called Moccasin Creek Road 560.0 feet to the point of beginning. Said real property containing __, acres, more or less.  It is the intent of the Grantors herein to convey all of their real property lying west of the so-called Moccasin Creek Road.

   This being the same property conveyed to Coty Garrett from John McDonald and wife, Sherry McDonald and Wade Ables by deed dated March 22, 2016 of record in Record Book 181, Page 515, Register’s Office of Wayne County, Tennessee.

   The sale of the above-described property shall be subject to all matters shown on any recorded plat; any unpaid taxes; any restrictive covenants, easements or set-back lines that may be applicable; any prior liens or encumbrances as well as any priority created by a fixture filing; and any matter that an accurate survey of the premises might disclose.

SUBORDINATE LIENHOLDERS: Wayne County, Tennessee delinquent property taxes

   All right and equity of redemption, statutory or otherwise, homestead, and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Trustee.

   The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
