Judge David L. Allen Issues Judgments in Wayne County Circuit Court

   Following are the judgments and probation revocation orders filed by Judge David L. Allen in the Criminal/Circuit Court of Wayne County during the months of December 2020 and January 2021:

   Kimberly Adams pled and was found guilty of introduction of contraband into a penal institution, a class D felony. She was sentenced to two years in TDOC, which was reduced to two years supervised probation. She will received credit for time served from 07/31/2020 to 11/20/2020.

   Phillip Beaulac pled and was found guilty of theft over $1,000 but less than $2,500, a class E felony. He was sentenced to two years in TDOC, with the sentence reduced to two years supervised probation. Beaulac was ordered to pay restitution to Blake Graves in the amount of $1,001.00, and was ordered to have no contact with Blake Graves or his property.

   Tyler Blue pled and was found guilty of aggravated assault, a class C felony; three counts of coercion of a witness, a class D felony; false imprisonment, a class A misdemeanor; and child endangerment, also a class A misdemeanor. He was sentenced to five years in TDOC on the assault charge, two years in TDOC on each of the coercion charges, and 11 months 29 days in county jail on each of the misdemeanor charges, with all sentences to run concurrently. Blue was further ordered to have no contact with Nydia Blue or the minor child, and was ordered to pay $200 in fines and costs. He will receive credit for time served from 04/17/2020 to 01/14/2021.

   Derek Brewer pled and was found guilty of theft of property $10,000-$60,000, a class C felony, and two counts of burglary of an auto, a class E felony. He was sentenced to four years in TDOC on the theft charge and two years in TDOC on each of the auto burglary charges, with all sentences to run concurrently. He was ordered to have no contact with Gregory Lewis Gean or his property, or with the Wayne County Board of Education or their property. Brewer will receive credit for time served from 02/14/2020 to 12/14/2020.

   Teresa Lynn Brown pled and was found guilty of introduction of contraband into a penal institution, a class D felony, and possession of schedule V Gabapentin, a class A misdemeanor. She was sentenced to two years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with both sentences reduced to supervised probation and to run concurrently. Brown was ordered to pay $800.00 in fines and costs.

   Cecil Bryant pled and was found guilty of sale of methamphetamine in an amount of 0.5 grams or less, a class C felony. He was sentenced to six years in TDOC, which was reduced to six years supervised probation. Bryant was ordered to pay $2,000.00 in fines. He will receive credit for time served from 10/19/2020 to 01/11/2021.

   Nicholas Ray Burns pled and was found guilty of two counts of burglary of an auto, a class E felony, and two counts of theft of $1,000 or less, a class A misdemeanor. He was sentenced to two years in TDOC on each of the felony charges and 11 months 29 days in county jail on each of the misdemeanor charges, with all sentences reduced to supervised probation. Burns was ordered to pay restitution to Kaleb Jones in the amount of $2,440.00, and was ordered to pay $100 in fines. He will receive credit for time served from 07/08/2020 to 08/07/2020.

   David Scott Eitniear II pled and was found guilty of burglary other than a habitation, a class D felony, and violation of an order of protection, a class A misdemeanor. He was sentenced to four years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with the sentences to run concurrently. He was further ordered to have no contact with Tammy Tipps or her property. Eitniear will receive credit for time served from 06/21/2020 to 09/22/2020 and from 10/08/2020 to 01/11/2021.

   Brandi Tennille Farris pled and was found guilty of possession of meth for resale in an amount less than 0.5 grams, a class C felony, and introduction of contraband into a penal institution, a class D felony. She was sentenced to six years in TDOC on the meth charge and two years in TDOC on the contraband charge, with the sentences to run concurrently. She was also ordered to pay $2,050.00 in fines. Farris will receive credit for time served from 07/17/2020 to 01/11/2021.

   Arron Justin French pled and was found guilty of possession of marijuana with intent to sell, a class E felony, and driving without a license, a class C misdemeanor. He was sentenced to two years in TDOC on the felony charge and 30 days in county jail on the misdemeanor, with both sentences reduced to supervised probation and to run concurrently.

   Dylan Lane Hanback pled and was found guilty of theft of property $10,000-$60,000, a class C felony, and burglary other than a habitation, a class D felony. He was sentenced to a total of eight years in TDOC, with both sentences reduced to supervised probation and to run concurrently. Hanback was ordered to have no contact with David Ross Berry or his property, and to pay restitution to Berry in the amount of $1,100.00.

   Austin Hayes pled and was found guilty of burglary other than a habitation, a class D felony. He was sentenced to four years in TDOC, with the sentence reduced to four years supervised probation. He was also ordered to pay $250 in fines. Hayes will receive credit for time served from 07/06/2020 to 01/11/2021.

   Tiffany Marie Hinojosa pled and was found guilty of simple possession of methamphetamine, a class A misdemeanor. She was sentenced to 11 months 29 days in county jail, which was reduced to 11 months 29 days supervised probation. She will receive credit for time served from 02/08/2020 to 02/11/2020.

   James Dalton Holderby pled and was found guilty of sexual battery by an authority figure, a class C felony; sexual battery, a class E felony; and soliciting sexual exploitation of a minor, also a class E felony. He was sentenced to a total of ten years in TDOC, with the sentences reduced to supervised probation and to run consecutively. Holderby was ordered to have no contact with the minor victims, and is to be placed on the sex offender registry. He will receive credit for time served from 11/29/2018 to 12/28/2018 and from 02/01/2019 to 01/14/2021.

   Derek Grant Jones pled and was found guilty of aggravated burglary, a class C felony, and theft of $1,000 or less, a class A misdemeanor. He was sentenced to three years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with the sentences to run concurrently. He will receive credit for time served from 06/19/2020 to 12/14/2020.

   Donnie Ray Kelley, Jr. pled and was found guilty of burglary and theft of $2,500 or more but less than $10,000, both class D felonies. He was sentenced to four years in TDOC on each charge, with both sentences reduced to supervised probation and to run concurrently after serving 80 days. Kelley was ordered to pay restitution to Glenda Robbins in the amount of $5,000.00. He will receive credit for time served from 11/19/2019 to 12/03/2019.

   Jerry Britt Long pled and was found guilty of aggravated burglary, a class C felony, and theft of $2,500 or more but less than $10,000, a class D felony. He was sentenced to three years in TDOC on the burglary charge and two years in TDOC on the theft charge, with the sentences to run concurrently. He will receive credit for time served from 08/24/2020 to 01/11/2021.

   Stephanie Pruett pled and was found guilty of possession of meth for resale in an amount less than 0.5 grams, a class C felony; possession of schedule III Suboxone, a class A misdemeanor; possession of drug paraphernalia, also a class A misdemeanor; and driving on revoked, a class B misdemeanor. She was sentenced to six years in TDOC on the felony charge, 11 months 29 days in county jail on the class A misdemeanors, and six months in county jail on the class B misdemeanor. All sentences were reduced to supervised probation and will run concurrently. Pruett was ordered to pay $2,450.00 in fines. She will receive credit for time served from 08/11/2020 to 01/11/2021.

   Nathan William Ritter pled and was found guilty of vehicular assault, a class D felony; simple possession/casual exchange of meth, DUI, and driving on a revoked license with priors, all class A misdemeanors; and driving on revoked, a class B misdemeanor. He was sentenced to three years in TDOC on the felony charge and 11 months 29 days in county jail on each of the misdemeanors, with all sentences to run concurrently. Ritter was ordered to pay $1,375.00 in fines. He will receive credit for time served from 12/05/2019 to 01/06/2020.

   Christopher Lee Thompson originally pled and was found guilty of possession of methamphetamine for resale, a class C felony. He applied for and was granted an order of judicial diversion, and was placed on supervised probation for a period of three years. He was ordered to pay $2,000.00 in fines plus costs.

   Telina Thompson pled and was found guilty of facilitation of the sale of methamphetamine, a class D felony. She was sentenced to three years in TDOC, with the sentence reduced to supervised probation.

   Roger D. West pled and was found guilty of three counts of vehicular assault, a class D felony, and DUI, a class A misdemeanor. He was sentenced to a total of eight years in TDOC on the felony charges and 11 months 29 days in county jail on the DUI charge. The felony sentences were combined into a total five-year package to be served, and the misdemeanor sentence was reduced to supervised probation. West will receive credit for time served from 03/07/2020 to 12/17/2020.

   Jason Dwight Bunch was originally convicted on a charge of aggravated burglary. He received a full revocation of probation, and was ordered to serve the remainder of his original sentence of four years. He will receive credit for time served from 04/23/2020 to 07/25/2020, from 09/16/2020 to 10/31/2020, and from 12/16/2020 to 01/14/2021.
