Following are the judgments and probation revocation orders filed by Judge David L. Allen in the Criminal/Circuit Court of Wayne County during the month of May 2021:
Philip Berry pled and was found guilty of possession of methamphetamine for resale in an amount of 0.5 grams or more, a class B felony. He was sentenced to ten years in TDOC, which was reduced to ten years supervised probation. He was also ordered to pay $2,000 in fines. Berry will receive credit for time served from 01/24/2020 to 01/28/2020.
Bobby Lee Dial pled and was found guilty of simple possession of methamphetamine and an enhanced charge of driving on a revoked license, both class A misdemeanors. He was sentenced to 11 months 29 days in county jail on each charge, with both sentences reduced to supervised probation after serving 120 days. Dial was ordered to pay $800 in fines. He will receive credit for time served from 01/28/2020 to 02/04/2020, from 06/17/2020 to 08/01/2020, and from 05/05/2021 to 05/10/2021.
Autumn Rose Hendricks pled and was found guilty of possession of methamphetamine for resale in an amount less than 0.5 grams, a class C felony, and possession of schedule I – Ecstasy, a class A misdemeanor. She was sentenced to five years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with both sentences reduced to supervised probation. Hendricks was ordered to pay $2,750 in fines.
Jimmy Murphy pled and was found guilty on three counts of sale of methamphetamine in an amount of 0.5 grams or more, a class B felony. He was sentenced to a 10-year Range I Standard Offender package in TDOC, and ordered to pay $6,000 in fines and court costs. Murphy will receive credit for time served from 10/01/2020 to 05/13/2021.
Makayla Perry pled and was found guilty of facilitation of the sale of methamphetamine, a class D felony. She was sentenced to two years in TDOC, which was reduced to two years supervised probation after serving 60 days. She was ordered to pay $2,000 in fines. Perry will receive credit for time served from 07/31/2020 to 10/29/2020 and from 04/20/2021 to 05/10/2021.
David Joe Pitts pled and was found guilty of criminal conspiracy to sell methamphetamine, a class C felony. He was sentenced to six years in TDOC, which was reduced to supervised probation after serving 180 days. He was ordered to pay $2,000 in fines plus court costs. Pitts will receive credit for time served from 10/19/2020 to 12/16/2020.
Michael E. Tilley pled and was found guilty of sale of methamphetamine in an amount of 0.5 grams or more and possession of methamphetamine for resale in an amount of 0.5 grams or more, both class B felonies. He was sentenced to ten years in TDOC on each charge, with the sentences to run concurrently. Tilley was ordered to pay $4,000 in fines. He will receive credit for time served from 10/28/2019 to 05/10/2021.
Nicholas Ray Burns was originally convicted on two counts of auto burglary and two counts of theft. He received a partial revocation of probation, with probation to be reinstated after serving 40 days in county jail.
Lauren Ashley Isom was originally convicted on one count of theft $10,000 to $60,000 and four counts of aggravated burglary. The state agreed to a termination of probation if fines and costs of $1,259.06 are paid in full by 06/14/2021. If the fines are not paid in full by that date, Isom will receive a full revocation of probation.
Jason Curtis Kilburn was originally convicted on two counts of burglary and two counts of theft $1,000 to $3,500. He received a partial revocation of probation, with probation to be reinstated after serving 120 days in county jail. Kilburn’s probation was extended two years from 05/13/2021.
Henry Marshall Murphy was originally convicted for aggravated assault. He received a partial revocation of probation, with probation to be reinstated after serving 180 days in county jail. Murphy’s probation was extended one year from 05/30/2022.
