Following are the judgments and probation revocation orders filed by Judge David L. Allen in the Criminal/Circuit Court of Wayne County during the months of February and March 2021:
Blake Anthony Adams pled and was found guilty of theft of $2,500 but less than $10,000, a class D felony; simple possession of meth, a class A misdemeanor; and failure to appear, also a class A misdemeanor. He was sentenced to three years in TDOC on the felony charge and 11 months 29 days in county jail on each of the misdemeanors, with all sentences reduced to supervised probation after serving 30 days in county jail and to run concurrently. Adams was ordered to pay restitution to Ancil Johnson in the amount of $1,149.00, and ordered to pay $800 in fines. He will receive credit for time served from 07/14/2020 to 02/08/2021.
Wesley Allen Atwell pled and was found guilty of burglary other than a habitation, a class D felony, and theft of $1,000 or less, a class A misdemeanor. He was sentenced to three years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor, with both sentences reduced to supervised probation after serving 150 days in county jail and to run concurrently. Atwell was ordered to pay restitution to William Myers Parker in the amount of $375. He will receive credit for time served from 05/25/2020 to 05/26/2020.
Paul Ashley Battles pled and was found guilty of aggravated assault, a class C felony; four counts of violation of an order of protection, a class A misdemeanor; and criminal impersonation, a class B misdemeanor. He was sentenced to three years in TDOC on the felony charge, 11 months 29 days in county jail on the class A misdemeanors, and six months in county jail on the class B misdemeanor. All sentences were reduced to supervised probation and will run concurrently. Battles was ordered to have no contact with his wife, Nikita Solway.
Stephen Boatwright pled and was found guilty of aggravated burglary, a class C felony, and theft of $2,500 or more but less than $10,000, a class D felony. He was sentenced to five years in TDOC on the class C felony and three years in TDOC on the class D felony, with the sentences reduced to supervised probation and to run concurrently. Boatwright was ordered to pay $5,000 in restitution at a minimum of $50 per month to Glenda Robbins. He will receive credit for time served from 08/25/2020 to 03/12/2021.
Jeremy Bonee pled and was found guilty of possession of meth for resale in an amount of 0.5 grams or more, a class B felony; possession of marijuana for resale, a class E felony; and possession of drug paraphernalia, a class A misdemeanor. He was sentenced to a total of ten years in TDOC on the felony charges and 11 months 29 days in county jail on the misdemeanor, with all sentences reduced to supervised probation and to run concurrently. Bonee was ordered to pay $2,050 in fines. He will receive credit for time served from 05/06/2020 to 05/15/2020.
Dustin P. Clay pled and was found guilty of sale of meth in an amount of 0.5 grams or more, a class B felony. He was sentenced to eight years in TDOC, with the sentence reduced to supervised probation after serving 240 days. Clay was ordered to pay $2,000 in fines, and will receive credit for time served from 10/30/2020 to 02/08/2021.
Shawn Dejean pled and was found guilty of sale of meth in amount of 0.5 grams or more, a class B felony. He was sentenced to eight years in TDOC, with the sentence reduced to supervised probation after serving 365 days. Dejean was ordered to pay $2,000 in fines, and will receive credit for time served from 10/18/2020 to 02/08/2021.
Michael Lee Dial pled and was found guilty of aggravated assault, a class C felony; felon in possession of a firearm, felony reckless endangerment, felony evading arrest, and DUI 4th offense, all class E misdemeanors; domestic assault, a class A misdemeanor; and driving on revoked, a class B misdemeanor. He was sentenced to a total package of six years in TDOC on the felony charge, and 11 months 29 days/six months in county jail on the misdemeanor charges. The misdemeanor sentences were reduced to supervised probation and will run concurrently. Dial received a full revocation of probation on previous charges of theft over $2,500, vandalism, and aggravated burglary. He was ordered to serve the remainder of his original sentence of five years on those charges.
Brandi Tennille Farris pled and was found guilty of possession of meth for resale in an amount less than 0.5 grams, a class C felony, and introduction of contraband into a penal facility, a class D felony. She was sentenced to six years in TDOC on the class C felony and two years in TDOC on the class D felony, with the sentences to run concurrently. She will receive credit for time served from 07/17/2020 to 01/11/2021.
Matthew Todd Freemon pled and was found guilty of simple possession of cocaine, a class A misdemeanor, and driving on a suspended license, a class B misdemeanor. He was sentenced to 11 months 29 days plus six months in county jail, with the sentences reduced to supervised probation and to run concurrently. Freemon was ordered to pay $850 in fines, and will lose his driver’s license for one year.
Cory Coridell Fuqua pled and was found guilty of criminal responsibility for the conduct of another, a class B felony. He was sentenced to six years in TDOC. He will receive credit for time served from 02/05/2018 to 01/31/2019.
Joseph Howard Hall pled and was found guilty of simple possession of cocaine, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail, with the sentence reduced to supervised probation. He was ordered to pay $750 in fines.
Rachel Hart pled and was found guilty of sale of meth in an amount of 0.5 grams or more, a class B felony. She was sentenced to eight years in TDOC, and ordered to pay $2,000 in fines. She will receive credit for time served from 10/01/2020 to 02/08/2021.
James Dalton Holderby pled and was found guilty of soliciting sexual exploitation of a minor by electronic means and two counts of sexual battery, all class E felonies. He was sentenced to a ten-year package in TDOC, suspended to probation on time served. He will serve the balance of his sentence, approximately eight years, on probation. He will receive credit for time served from 11/29/2018 to 12/28/2018 and from 02/01/2019 to 01/14/2021. Holderby is allowed to visit with his minor siblings and niece, but is to have no contact with his minor victims.
Erik David Holt pled and was found guilty on two counts of sale of meth in an amount of 0.5 grams or more, a class B felony; simple possession of schedule VI marijuana, a class A misdemeanor; and possession of drug paraphernalia, also a class A misdemeanor. He was sentenced to a ten-year package sentence in TDOC as a Range I Standard Offender. He was ordered to pay court costs and fines of $4,400. Holt will receive pretrial credit for time served to date of entry of plea.
Jennifer Carlene Horton pled and was found guilty of criminal responsibility for sale of meth in an amount of 0.5 grams or more, a class B felony. She was sentenced to ten years in TDOC, which was reduced to supervised probation after serving six months. Horton was ordered to pay $2,000 in fines, and will be placed on the Tennessee Drug Offender Registry for up to a ten-year period. She will receive credit for time served from 11/01/2020 to 02/11/2021.
Jerry Alan Johnson pled and was found guilty of sale of meth in an amount less than 0.5 grams, a class C felony, and possession of drug paraphernalia, a class A misdemeanor. He was sentenced to four years in TDOC on the felony charge, and 11 months 29 days in county jail on the misdemeanor. Both sentences were reduced to supervised probation after serving 182 days. Johnson was ordered to pay $2,150 in fines and court costs. He will receive credit for time served from 10/01/2020 to 03/12/2021.
Colby Daniel Mathis pled and was found guilty on two counts of aggravated burglary, a class C felony; two counts of burglary other than a habitation and two counts of theft of $2,500 or more but less than $10,000, all class D felonies; vandalism over $1,000, a class E felony; and vandalism of $1,000 or less, theft of $1,000 or less, and resisting arrest, all class A misdemeanors. He was sentenced to six years in TDOC on the class C felonies, four years in TDOC on the class D felonies, two years in TDOC on the class E felony, and 11 months 29 days x 2 plus six months on the misdemeanor charges. All sentences were reduced to supervised probation after serving 75% of the misdemeanor sentences in county jail. A condition in all Mathis’ cases is successful completion of Recovery Court. He was ordered to pay restitution to Jason Neal Staggs in the amount of $1,000, to Sam Phillips in the amount of $2,700, and to Wayne County Farmers Co-Op in the amount of $584. Mathis was further ordered to have no contact with Jason Staggs, Sam Phillips, Wayne Farmers Co-Op, Bill Hicks, or Janice Brewer.
Lee Brice McCurry pled and was found guilty on two counts of simple possession/casual exchange of methamphetamine, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail on each charge, with the sentences reduced to supervised probation after serving 30 days and to run concurrently. He will receive credit for time served from 10/19/2020 to 03/12/2021. McCurry also received a full revocation of probation on a previous charge of possession of meth for resale, and was ordered to serve the remainder of his original six-year sentence.
James Mitchell pled and was found guilty of possession of meth for resale in an amount of 0.5 grams or more, a class B felony. He was sentenced to eight years in TDOC. He will receive credit for time served from 07/07/2015 to 07/31/2015, from 06/07/2017 to 02/07/2018, and from 02/07/2018 to 03/12/2021.
Roger Ragland pled and was found guilty of possession of meth for resale in an amount less than 0.5 grams, a class C felony, and possession of drug paraphernalia, a class A misdemeanor. He was sentenced to six years in TDOC on the felony charge and 11 months 29 days in county jail on the misdemeanor. Both sentences were reduced to supervised probation after serving 150 days in county jail, and will run concurrently. Ragland was ordered to pay $2,150 in fines.
Yulonda Sanders pled and was found guilty of possession of meth for resale in an amount of 0.5 grams or more, a class B felony, and two counts of driving without a license, a class C misdemeanor. She was sentenced to ten years in TDOC on the felony charge and 30 days in county jail on each of the misdemeanors, with the sentences reduced to supervised probation and to run concurrently. She was ordered to pay $2,100 in fines. Sanders will receive credit for time served from 02/12/2020 to 02/26/2020.
Brandon Hugh Thompson pled and was found guilty of possession of drug paraphernalia, a class A misdemeanor. He was sentenced to 11 months 29 days in county jail, with the sentence reduced to supervised probation.
Donna Waters pled and was found guilty of facilitation of the sale of methamphetamine, a class C felony. She was sentenced to five years in TDOC, which was reduced to supervised probation after serving 45 days in county jail. Waters was ordered to pay $2,000 in fines. She will receive credit for time served from 10/19/2020 to 10/30/2020.
Sayble Delane Jones originally pled and was found guilty of accessory after the fact-1st degree, a class E felony. She applied for and was granted an order of judicial diversion, and was placed on supervised probation for a period of one year.
Elijah Richard Lee Ferguson was originally convicted on charges of aggravated burglary, two counts of theft, auto burglary, and vandalism. He received a partial revocation of probation, with probation to be reinstated after serving 90 days in county jail.
Brandon David Hand was originally convicted on charges of theft of $3,500 or more and theft $10,000-$60,000. He received a full revocation of probation and was ordered to serve the remainder of his original sentence of five years.
Roy Dee Horton was originally convicted on a charge of possession of methamphetamine. He received a partial revocation of probation, with probation to be reinstated after serving 120 days in county jail.
Benjamin Moon McCabe was originally convicted on a charge of felony evading arrest. He received a full revocation of probation and was ordered to serve the remainder of his original sentence of five years.
Jesse James Rumbaugh was originally convicted on a charge of theft over $1,000 and three counts of auto burglary. He received a partial revocation of probation, with probation to be reinstated after serving 150 days in county jail.
Michael James Waters was originally convicted on charges of possession of less than 0.5 grams of meth for resale and possession of schedule II drugs. He received a partial revocation of probation, with probation to be reinstated after serving 150 days in county jail.
